Fiduciary Litigation

Fiduciary litigation involves legal disputes where a breach of trust, duty, or loyalty by someone in a position of responsibility, such as a trustee, executor, corporate officer, or financial advisor, is alleged. At our firm, we represent beneficiaries, trustees, executors, and other fiduciaries in complex disputes arising from these relationships.

Shields Law PLLC's Fiduciary litigation services include:

  • Trust and Estate Disputes: Representing beneficiaries or fiduciaries in disputes involving wills, trusts, and the administration of estates, including allegations of mismanagement, undue influence, or failure to fulfill fiduciary duties.
  • Breach of Fiduciary Duty: Pursuing or defending claims of breach of duty by corporate officers, directors, financial advisors, or other fiduciaries involving issues such as conflicts of interest, self-dealing, or failure to act in the best interests of beneficiaries.
  • Trustee and Executor Removal: Assisting in the removal of fiduciaries who have acted improperly or are unfit to manage trust or estate assets.
  • Accounting and Surcharge Actions: Initiating or defending actions to compel a fiduciary to provide an accounting of their management of assets and seek surcharges or damages for improper handling.
  •  Business Fiduciary Disputes: Handling cases involving corporate governance, partnership disputes, and breach of fiduciary duty in business settings.

Attorney Marcus A. Shields  is skilled at navigating the complexities of fiduciary relationships and working toward a resolution, whether through negotiation, mediation, or aggressive representation in court. Frequently Asked Questions

Please reach us at contact@shieldslawnc.com if you cannot find an answer to your question.

Congratulations on taking a step to protect your loved ones and yourself by considering estate planning and an estate planning attorney. It is an important step that we believe everyone should take for their peace of mind. While you technically can draft legal documents such as Wills on your own, it is helpful to have an experienced estate planning Attorney help you navigate the legal process to ensure your Wills, Trusts, Power of Attorney, and other estate documents give you the protections you intend. There may also be documents that we suggest you consider that you may not have thought of, and we can help you complete them all to give you peace of mind. If you have questions or are ready to begin planning your estate, Schedule a Consultation with us to discuss your specific estate planning needs.

Every client's needs are different, but we generally recommend that you consider a Will, Trust, Power of Attorney, Beneficiary Designation, Healthcare Power of Attorney, Letter of Intent, and  Guardianship Designation. This may sound daunting but an experienced Estate Planning Attorney like Shields Law can evaluate your case and help you create the essentials you actually need.
